A muchos les han dicho las autoridades que esperen a que se actualice. \u00bfSabes qu\u00e9 significa el estado &#8220;actual&#8221; de una fecha de prioridad, durante cu\u00e1nto tiempo es v\u00e1lida y c\u00f3mo funciona en el escenario temporal de tu tarjeta verde? Aqu\u00ed aclararemos esa confusi\u00f3n, porque leer mal el bolet\u00edn tiene consecuencias reales para tu caso.   <\/p><p>He aqu\u00ed el problema central que el bolet\u00edn pretende resolver. El Congreso limita el n\u00famero de tarjetas verdes que el USCIS puede expedir cada a\u00f1o en la mayor\u00eda de las categor\u00edas familiares y laborales. Esos l\u00edmites se establecen en la <strong>Ley de Inmigraci\u00f3n y Nacionalidad<\/strong>. Las cifras no son grandes en relaci\u00f3n con el volumen de personas que las solicitan. Cuando hay m\u00e1s peticiones pendientes en una categor\u00eda que visados disponibles para el a\u00f1o, la gente espera. El bolet\u00edn de visados es la forma que tiene el gobierno de gestionar esa espera; te dice, mes a mes, cu\u00e1nto ha avanzado la cola.     <\/p><p>Tu posici\u00f3n en esa l\u00ednea viene determinada por tu fecha de prioridad. Para una petici\u00f3n basada en la familia, esa fecha se registra cuando USCIS acepta tu <a href=\"https:\/\/www.uscis.gov\/i-130\" rel=\"nofollow noopener\" target=\"_blank\">formulario I-130<\/a>. Para los casos basados en el empleo, es la fecha de recepci\u00f3n del I-140 o la fecha en que se present\u00f3 la <a href=\"https:\/\/www.dol.gov\/agencies\/eta\/foreign-labor\/programs\/permanent\" rel=\"nofollow noopener\" target=\"_blank\">certificaci\u00f3n laboral PERM<\/a> de tu empleador ante el Departamento de Trabajo, dependiendo de cu\u00e1l se aplique a tu caso. Esa fecha no cambia. Lo que cambia cada mes es la fecha l\u00edmite publicada en el bolet\u00edn para tu categor\u00eda de visado y tu pa\u00eds de nacimiento. Cuando la fecha l\u00edmite del bolet\u00edn pasa de tu fecha de prioridad, tu n\u00famero ha subido; puedes proceder con el formulario I-485 para ajustar el estatus aqu\u00ed en EE.UU. Por otro lado, puedes seguir adelante con una entrevista consular de visado de inmigrante en una embajada o consulado de EE.UU. en el extranjero.     <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-199d85d elementor-widget elementor-widget-text-editor\" data-id=\"199d85d\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span class=\"TextRun SCXW213203855 BCX0\" lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW213203855 BCX0\">Los n\u00fameros detr\u00e1s de la espera INA 202:<\/span><\/span><span class=\"TextRun SCXW213203855 BCX0\" lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW213203855 BCX0\">  Para el a\u00f1o fiscal 2026, el Congreso autoriz\u00f3  <\/span><\/span><span class=\"TextRun SCXW213203855 BCX0\" lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW213203855 BCX0\">226,000<\/span><\/span><span class=\"TextRun SCXW213203855 BCX0\" lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW213203855 BCX0\">  visados preferentes patrocinados por la familia y un m\u00ednimo de  <\/span><\/span><span class=\"TextRun SCXW213203855 BCX0\" lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW213203855 BCX0\">140,000<\/span><\/span><span class=\"TextRun SCXW213203855 BCX0\" lang=\"EN-US\" data-contrast=\"auto\"> <span class=\"NormalTextRun SCXW213203855 BCX0\"> visados preferentes basados en el empleo en todo el mundo. <\/span><span class=\"NormalTextRun SCXW213203855 BCX0\">Ning\u00fan pa\u00eds puede utilizar m\u00e1s del 7% del total combinado <\/span><span class=\"NormalTextRun AdvancedProofingIssueV2Themed SCXW213203855 BCX0\">en un a\u00f1o determinado<\/span><span class=\"NormalTextRun SCXW213203855 BCX0\">lo que equivale a <\/span><span class=\"NormalTextRun SCXW213203855 BCX0\">aproximadamente <\/span> <\/span><span class=\"TextRun SCXW213203855 BCX0\" lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW213203855 BCX0\">25,620<\/span><span class=\"NormalTextRun SCXW213203855 BCX0\"> visados<\/span><\/span><span class=\"TextRun SCXW213203855 BCX0\" lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW213203855 BCX0\">.<\/span><span class=\"NormalTextRun SCXW213203855 BCX0\">  Ese l\u00edmite se aplica independientemente del n\u00famero de solicitantes de ese pa\u00eds que est\u00e9n esperando. Es la raz\u00f3n por la que un solicitante nacido en India o M\u00e9xico en la misma categor\u00eda de visado que alguien nacido en, digamos, Polonia o Brasil puede estar esperando   <\/span><span class=\"NormalTextRun SCXW213203855 BCX0\">10<\/span><span class=\"NormalTextRun SCXW213203855 BCX0\"> a <\/span><span class=\"NormalTextRun SCXW213203855 BCX0\">20<\/span><span class=\"NormalTextRun SCXW213203855 BCX0\">  a\u00f1os m\u00e1s. Confundirlas es un error frecuente y costoso. Presentar la solicitud seg\u00fan la tabla equivocada o saltarse un plazo de presentaci\u00f3n autorizado puede retrasar un caso durante meses.  <\/p><p>La primera es la tabla de la Fecha de Acci\u00f3n Final (FAD). Es la que rige cu\u00e1ndo puede expedirse un n\u00famero de visado o cu\u00e1ndo aprobar\u00e1 USCIS una solicitud de ajuste de estatus. Tu fecha de prioridad debe ser anterior a la fecha l\u00edmite de la FAD para tu categor\u00eda y pa\u00eds antes de que se pueda finalizar nada. El USCIS considera que \u00e9sta es la tabla por defecto para las solicitudes I-485. Si no est\u00e1s seguro de qu\u00e9 tabla se aplica este mes, consulta <a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/legal\/visa-law0\/visa-bulletin\/2026\/visa-bulletin-for-june-2026.html\" rel=\"nofollow noopener\" target=\"_blank\">uscis.gov<\/a>. Esta p\u00e1gina se actualiza a principios de cada mes y es la fuente autorizada.     <\/p><p>La segunda es <strong>la tabla de Fechas de Presentaci\u00f3n (DFF)<\/strong>. El USCIS no siempre autoriza su uso; a veces lo hace y a veces no. Cuando lo hacen, los solicitantes cuyas fechas de prioridad caen antes del corte de la DFF pueden iniciar el proceso de presentaci\u00f3n aunque su fecha a\u00fan no haya pasado la tabla de la DFF. \u00bfPor qu\u00e9 es importante? Porque presentar la solicitud seg\u00fan la tabla DFF, cuando el USCIS lo permite, te permite presentar el Formulario I-485 simult\u00e1neamente con el Formulario I-765 para la autorizaci\u00f3n de empleo y el Formulario I-131 para la libertad condicional anticipada. Esos dos beneficios, el derecho a trabajar y el derecho a viajar, pueden estar en tu mano meses antes de que se despeje totalmente tu fecha de prioridad.     <\/p><p><strong>Procedimiento para determinar las fechas en junio de 2026:<br><\/strong><\/p><ul><li>Los funcionarios consulares de las embajadas y consulados de EE.UU. deben informar al Departamento de Estado de los solicitantes de visados num\u00e9ricamente limitados que re\u00fanan los requisitos documentales. En el \u00e1mbito nacional, el USCIS informa por separado de todos los solicitantes que han solicitado el ajuste de estatus dentro de Estados Unidos. <\/li><li>Las asignaciones de n\u00fameros de visado que aparecen en los gr\u00e1ficos del Bolet\u00edn de Visados se realizan, en la medida de lo posible, por orden cronol\u00f3gico, bas\u00e1ndose en las fechas de prioridad comunicadas. Las cifras de demanda utilizadas para preparar dichas asignaciones reflejan las solicitudes recibidas hasta <strong>el 4 de mayo de 2026<\/strong>. <\/li><li>Cuando el volumen de la demanda de una categor\u00eda de visado espec\u00edfica o de solicitantes de un pa\u00eds extranjero concreto supera lo que el l\u00edmite num\u00e9rico puede acomodar, esa categor\u00eda o pa\u00eds se designa formalmente como saturado.<\/li><li>Para cualquier categor\u00eda con exceso de solicitudes, la Fecha de Acci\u00f3n Final que se publica corresponde a la fecha de prioridad del primer solicitante cuyo caso no pudo ser atendido dentro del l\u00edmite num\u00e9rico disponible. Todos los que queden por detr\u00e1s de esa fecha deben esperar. <\/li><li>Si una Fecha de Acci\u00f3n Final se retrotrae en cualquier momento durante el actual proceso de asignaci\u00f3n mensual, las solicitudes suplementarias de n\u00fameros de visado s\u00f3lo se aceptar\u00e1n si la fecha de prioridad del solicitante cae en o antes de la Fecha de Acci\u00f3n Final reci\u00e9n anunciada y publicada en el bolet\u00edn de junio. Las solicitudes anteriores vinculadas a la fecha anterior no ser\u00e1n atendidas. <\/li><li>Si en alg\u00fan momento se alcanza un l\u00edmite num\u00e9rico anual, la categor\u00eda de preferencia afectada debe designarse inmediatamente como no disponible. A partir de ese momento, no se tendr\u00e1n en cuenta m\u00e1s solicitudes de n\u00fameros bajo esa categor\u00eda. <\/li><\/ul><p><strong> <\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-96dab05 e-flex e-con-boxed e-con categor\u00edas patrocinadas por la familia?  <\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-dea788b elementor-widget__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"dea788b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>El sistema de preferencia familiar abarca cuatro categor\u00edas: F1, F2, F3 y F4, cada una vinculada a una relaci\u00f3n familiar espec\u00edfica con un ciudadano estadounidense o un residente legal permanente.<br\/>La tabla siguiente refleja las Fechas de Acci\u00f3n Final (FAD) oficiales para junio de 2026, publicadas por el Departamento de Estado Seg\u00fan la INA 202, <strong>ning\u00fan pa\u00eds obtiene m\u00e1s del 7% de la asignaci\u00f3n total anual de visados por motivos familiares y de empleo:<\/strong> aproximadamente 25.620 visados para el a\u00f1o fiscal 2026. Ese tope se aplica de la misma manera, independientemente del n\u00famero de personas de ese pa\u00eds que est\u00e9n esperando. India env\u00eda cada a\u00f1o muchas m\u00e1s peticiones EB-2 y EB-3 a trav\u00e9s de USCIS que pa\u00edses de una fracci\u00f3n de su tama\u00f1o. El l\u00edmite por pa\u00eds no se flexiona para reflejar eso. Por tanto, el l\u00edmite se llena r\u00e1pidamente, el retraso crece y se agrava a\u00f1o tras a\u00f1o.      Esto no conlleva ninguna penalizaci\u00f3n.<\/p><p>La categor\u00eda EB-2 lo concreta. La EB-2 cubre a los profesionales con titulaci\u00f3n superior. Ahora mismo, en junio de 2026, un solicitante EB-2 nacido en Alemania, Brasil o Nigeria puede presentar la solicitud. La categor\u00eda est\u00e1 vigente para ellos. Un solicitante EB-2 nacido en la India con las mismas credenciales, el mismo empleador y un I-140 aprobado en el mismo sistema del USCIS tiene como fecha de acci\u00f3n final el 15 de julio de 2014. El USCIS est\u00e1 tramitando casos de hace m\u00e1s de una d\u00e9cada para ese grupo.      Nos hemos sentado con clientes que llevan ocho, diez o doce a\u00f1os en este pa\u00eds con pr\u00f3rrogas H-1B, esperando a que se mueva esa fecha.<\/p><p>El Congreso es consciente de este desequilibrio desde hace a\u00f1os. Varias propuestas legislativas han intentado abordarlo, pero ninguna ha sido aprobada. Hasta que se introduzcan esos cambios, los solicitantes de estos pa\u00edses deben trabajar con un abogado que conozca las opciones disponibles con arreglo a la legislaci\u00f3n actual. Eso incluye revisar si la portabilidad de la categor\u00eda EB conforme al art\u00edculo 204(j) de la INA se aplica a tu caso, si las solicitudes concurrentes pueden utilizarse para obtener antes la autorizaci\u00f3n de empleo y la libertad condicional anticipada y, para los titulares de permisos de residencia en esta situaci\u00f3n, si el momento de la solicitud de naturalizaci\u00f3n puede convertir la petici\u00f3n de preferencia pendiente de un familiar en una petici\u00f3n de familiar inmediato, evitando por completo el l\u00edmite. No se trata de soluciones provisionales. Son estrategias de planificaci\u00f3n leg\u00edtimas incluidas en la ley.
