What Is Family-Based Immigration?

Family based immigration is a way for U.S. citizens and permanent residents to sponsor their close family members to come to the U.S. and become permanent residents lawfully. This process ensures that you do not have to spend your life away from family and loved ones.

There are two main kinds of family-based immigration visas:
1- IR or Immediate Relative Visas: Typically for spouses, parents, or unmarried children under the age of 21 of U.S. residents.

2- F or Family Preference Visas: This visa is eligible for close family members such as siblings, adult children of U.S. citizens, or some relatives of the green card holders.

Our lawyers at the Coleman Law Group will assess your eligibility and, after determining the correct visa category to which you or your relatives belong, will create a solid petition that ensures your case moves forward swiftly without unnecessary delays.

How Our Immigration Lawyers Can Help

The application and filing process for family-based immigration is not only complex but can also feel lengthy at times. However, because it is time-sensitive, the lawyers at the Coleman Law Group are fully equipped to gather the required information and assist you in applying as soon as possible with skill and care.

There are a few important steps that go into the immigration process, and our team of lawyers will help you:
1- Preparing and filing Form I-130 and the documents required with it.
2- Proof of family relations is another important document required.
3- Conducting and managing communications with the USCIS and the consular officer of your country.
4- Need to handle requests for any additional evidence.
5- Representing you if there is a requirement for appeals or waiver cases.

Every case is unique and cannot be handled in the same way as the last one. That is where the experience of our lawyers comes in. Our main goal is always to make the process less complicated and smoother for you and your family.

Frequently Asked Questions

Can my friend in the USA sponsor me?
No, your friends cannot sponsor you through family-based immigration. A sponsorship can only be initiated via family members/immediate relatives, such as parents, spouses, children, or siblings.
The two main categories are family preference visas and immediate relative visas. You can sponsor your close family with the Immediate Relative visa and can sponsor your distant relatives, such as adult children or siblings, with the Family Preference visa.
The processing time ranges from 6 months to a few years, but it varies depending on the type of sponsorship, country, and whether it’s from within the USA or outside. The Immediate Relative visa moves faster than the Family Preference visa.
The eligible relatives are spouses, children, parents, and siblings of the U.S. citizens or permanent residents. It mostly depends on the kind of visa category.
When funding parents, you normally need to provide the most current three years of tax returns to prove you meet the income conditions for the Affidavit of Support (Form I-864).
We believe that every case is unique and hence deserves a different kind of attention and empathy. Even if your case is different from most cases and if you feel that it has a sensitive history, you can relax and let us handle it without any judgment and complete confidentiality.
Family-based immigration lets qualified relatives reunite in the U.S. It provides a way for loved ones to live together legally and can lead to permanent residency. This process also helps families build stable futures together.

We at Coleman Law Group very well understand that the distressing situation of separation from family is one of the most difficult situations one has to face. But you do not have to worry; our team of family-based immigration lawyers is dedicated to carving out legal ways for you to reunite with your family. It can be through petitions or waivers; our goal is to help you reunite with your loved ones.
