What We Actually Do During Mediation

A mediator isn’t a judge. Nobody walks out of mediation with a ruling handed down from above. What happens instead is that both spouses sit down—sometimes together, sometimes in separate rooms, and work through the issues that need to be settled: the kids, the house, support, retirement accounts.

Our job is to make sure Florida law is part of that conversation, that nothing important slips through the cracks, and that whatever both parties agree to gets written up properly, so it actually holds up in court. We’ve cleaned up too many informal agreements that fell apart six months later because nobody handled the paperwork right the first time.

What People Get Out of Mediation That Court Can't Give Them

Here’s something a lot of people don’t think about until it’s too late. When a divorce goes to trial, a judge who has spent maybe a few hours on your file makes the final call on your children’s lives and your finances. That’s the reality of litigation.

Mediation hands that control back to the two people who actually have to live with the outcome. In our experience, agreements that both spouses helped shape hold up far better over time than orders a judge imposed. People follow agreements they had a voice in. They fight orders they didn’t give.

The privacy piece matters too. Nothing said in mediation becomes a public court record. That’s not a small thing when children are involved.

Faster Than Court and Nobody Else's Business

A contested divorce in Florida is one where the parties can’t agree, and a judge has to decide it. Its process commonly runs a year to eighteen months. Sometimes it’s longer. Court calendars are backed up; motions pile up, and every back-and-forth between attorneys runs the bill higher.

Mediation moves differently. Couples who come in prepared and willing to work through the big issues seriously can often settle the same in a week rather than a year. And because mediation sessions are completely private and off the public record, both spouses can speak honestly without worrying that something said at the table gets dragged into a courtroom later. For families in St. Pete, Tampa, Clearwater, and Sarasota, that combination of speed and privacy is often what decides for them.

Before You Decide Anything, Talk to Us

People come to Coleman Law Group after making decisions they can’t undo and agreeing to informal arrangements that weren’t legally sound. In such scenario, walking into mediation without knowing what they were entitled to, or spending a year in litigation on a case that could have been settled in two months.

Don’t be that person. If you’re going through a divorce in St. Petersburg, Tampa, Clearwater, or Sarasota and trying to figure out whether mediation makes sense, call the Coleman Law Group at 727-214-0400.

One conversation will tell you a lot — including if mediation isn’t the right call for your situation. We’d rather tell you that upfront than have you find out the hard way.

Frequently Asked Questions

What does a divorce mediation attorney actually do?
They keep both spouses working through the real issues — kids, property, support — and make sure whatever agreement comes out is written up correctly, so it holds up in court.
In most cases, yes. Courts here require couples to attempt mediation before a final hearing is scheduled. Coming unprepared is a mistake that costs people time and leverage.
Couples who come in ready to work usually get through the key issues in a few sessions — weeks, not the year-plus that litigation commonly runs.
Almost always, and often by a lot. Less attorney time, fewer court appearances, no trial prep. The cost gap between a mediated divorce and a fully litigated one can be significant.
Parenting plans, time-sharing, child support, property division, and alimony. Most of what ends up in front of a judge can be settled at the mediation table if both parties are serious.
Yes. Whatever is discussed in the mediation room between the attorney and both parties will remain there. If couples are unable to reach an agreement, nothing from those sessions can be included or discussed into court proceedings later.
Yes — and honestly, you should. Signing any agreement without having your own attorney look at it first is a risk that catches people off guard later.
Couples willing to have hard conversations without turning everything into a war — especially parents who want to keep the process from making things worse for their kids than the divorce already has.
